Terms of Service

1. Acceptance of These Terms

By creating an account, purchasing a subscription or credit package, accessing the EstateAI website, or using any EstateAI feature, you agree to these Terms of Service.

If you do not agree to these Terms, you must not access or use EstateAI.

If you use EstateAI on behalf of a company, agency, brokerage, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

2. About EstateAI

EstateAI is an AI-powered real estate marketing platform operated by Pixel Perfects Solutions.

EstateAI may provide services including:

• Virtual staging
• Image enhancement
• Day-to-dusk conversion
• Virtual decluttering
• Interior redesign
• Virtual renovation
• Property-media organization
• Image generation and transformation
• Downloads and sharing
• Property marketing and collaboration tools
• Other AI-powered and professional services

Features may be added, modified, suspended, or discontinued at any time.

3. Eligibility

You must be legally capable of entering into a binding agreement to use EstateAI.

EstateAI is intended for professional and business use. You may not use the service if applicable law prohibits you from doing so.

4. Accounts

You must provide accurate and current account information and keep it updated.

You are responsible for:

• Maintaining the confidentiality of your account
• Protecting your authentication credentials
• All activity performed through your account
• Immediately reporting suspected unauthorized access

You may not share account credentials in a way that violates your subscription limits or allows unauthorized access.

5. Social Sign-In

EstateAI may allow you to sign in using third-party identity providers such as Google, Facebook, or Apple.

Your use of those providers is also subject to their applicable terms and privacy policies.

6. User Content

User Content includes photographs, images, property information, prompts, instructions, logos, client information, files, and other materials submitted to EstateAI.

You retain ownership of your User Content, subject to the permissions granted in these Terms.

You grant EstateAI and Pixel Perfects Solutions a limited, non-exclusive, worldwide license to host, store, copy, process, transmit, modify, display, and create outputs from User Content solely as needed to:

• Provide the requested services
• Operate and maintain the platform
• Generate and deliver AI outputs
• Prevent abuse and maintain security
• Comply with legal obligations
• Provide support and resolve technical issues

This license ends when the relevant content is deleted, except where retention is required for backups, legal obligations, security, billing, or dispute resolution.

7. Your Responsibilities for Uploaded Content

You represent and warrant that:

• You own or have permission to use all uploaded content
• You have authority to request processing of the content
• Your content does not violate privacy or intellectual-property rights
• Your content does not violate any law or contractual obligation
• You have obtained any required client or property-owner authorization

You are solely responsible for confirming that uploaded media may lawfully be processed, modified, downloaded, distributed, or published.

8. AI-Generated and AI-Modified Content

EstateAI uses artificial-intelligence systems that may produce inaccurate, incomplete, unrealistic, inconsistent, or unexpected results.

AI-generated and AI-modified images may not perfectly represent the actual condition, dimensions, structure, materials, furniture, lighting, finishes, or appearance of a property.

You are responsible for reviewing all outputs before using, sharing, advertising, publishing, or delivering them.

You are also responsible for complying with any disclosure requirements that apply to virtually staged, digitally altered, enhanced, renovated, or AI-generated real estate media.

9. Prohibited Uses

You may not use EstateAI to:

• Violate any law or regulation
• Infringe intellectual-property, privacy, publicity, or contractual rights
• Upload content you do not have permission to use
• Create fraudulent, deceptive, defamatory, or misleading materials
• Misrepresent the physical condition of a property unlawfully
• Generate abusive, hateful, sexually exploitative, or illegal content
• Upload malware, malicious code, or harmful files
• Attempt to bypass authentication, billing, credits, or security controls
• Reverse engineer, scrape, copy, resell, or exploit the service without authorization
• Interfere with EstateAI infrastructure or other users
• Use automated systems that place unreasonable load on the platform
• Use EstateAI to develop or train competing products without written permission

10. Subscriptions

EstateAI may offer recurring subscription plans with different features, credits, storage limits, processing limits, and project or property limits.

Subscription fees are billed in advance according to the selected billing cycle.

Subscriptions automatically renew unless cancelled before the renewal date.

You authorize EstateAI and its payment processor to charge your payment method for subscription fees, taxes, and other authorized charges.

11. Credits

EstateAI may use credits to measure access to AI processing and related services.

Different services may consume different numbers of credits. Credit costs may change as features, providers, processing requirements, or pricing change.

Unless otherwise stated:

• Credits have no cash value
• Credits may not be transferred or resold
• Credits may only be used within EstateAI
• Unused subscription credits may expire at the end of a billing period
• Purchased credits may be subject to separate expiration rules
• Promotional credits may expire according to their offer terms

EstateAI may reverse or correct credits issued because of fraud, error, abuse, payment reversal, or technical failure.

12. Payments and Billing

Payments are processed through Stripe or another authorized payment processor.

You agree to provide accurate billing information and maintain a valid payment method.

Taxes, bank charges, currency-conversion costs, and payment processor fees may apply where permitted.

13. Cancellations

You may cancel a subscription through the available billing portal or by contacting support.

Cancellation normally takes effect at the end of the current billing period unless otherwise stated.

You will generally retain access to paid features until the end of the already-paid billing period.

14. Refunds

Except where required by law, subscription fees, credit purchases, and completed services are non-refundable.

Refund requests may be reviewed individually in cases involving duplicate charges, verified billing errors, or significant service failure.

Consumed credits, completed AI jobs, and downloaded outputs are generally not eligible for refund.

15. Failed and Interrupted Processing

AI processing may fail or be delayed because of invalid inputs, third-party outages, provider limits, connectivity problems, maintenance, or technical errors.

EstateAI may automatically retry a job, return credits, or provide another reasonable remedy when a confirmed processing failure occurs.

16. Storage and Deletion

Plans may include storage limits. EstateAI may prevent new uploads or require deletion or an upgrade when limits are reached.

You are responsible for downloading and maintaining copies of important content.

EstateAI is not a permanent archival or backup service.

Content may be removed after account termination, plan expiration, prolonged inactivity, policy violation, or a valid deletion request.

17. Sharing and Public Links

You are responsible for all share links created through your account.

Anyone with access to an unrestricted public link may be able to view, copy, download, or distribute its associated content.

You should use passwords, expiration dates, restricted access, or other available controls where appropriate.

18. Intellectual Property

EstateAI, its software, interface, branding, designs, workflows, documentation, trademarks, logos, and platform technology are owned by or licensed to Pixel Perfects Solutions.

These Terms do not grant you ownership of EstateAI technology or branding.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from EstateAI except where applicable law expressly permits it.

19. Feedback

If you provide suggestions, ideas, or feedback, you grant Pixel Perfects Solutions permission to use that feedback without restriction or compensation.

20. Third-Party Services

EstateAI relies on third-party providers for authentication, payments, hosting, storage, databases, analytics, monitoring, communications, and AI processing.

EstateAI is not responsible for third-party outages, changes, errors, suspensions, security incidents, or service availability outside its reasonable control.

21. Beta and Experimental Features

Some features may be identified as beta, preview, experimental, or early access.

These features may be incomplete, unstable, modified, or discontinued without notice.

22. Suspension and Termination

EstateAI may suspend, restrict, or terminate access when:

• You violate these Terms
• Payments fail or remain unpaid
• Your activity creates security, legal, or operational risk
• Your use is abusive, fraudulent, or harmful
• Suspension is required by law or a service provider

You may stop using EstateAI at any time and may request account deletion through our Data Deletion Instructions.

23. Service Availability

EstateAI is provided on an as-available basis.

We do not guarantee uninterrupted operation, permanent storage, error-free results, fixed processing times, or availability of every feature in every location.

24. Disclaimers

To the maximum extent permitted by law, EstateAI is provided without warranties of any kind, whether express, implied, or statutory.

We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, and suitability of AI-generated outputs.

EstateAI does not provide legal, architectural, engineering, appraisal, inspection, financial, or real estate brokerage advice.

25. Limitation of Liability

To the maximum extent permitted by law, Pixel Perfects Solutions and its affiliates, officers, employees, contractors, providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

This includes loss of profits, revenue, data, business, reputation, opportunities, or property transactions.

To the maximum extent permitted by law, total liability arising from EstateAI will not exceed the amount you paid to EstateAI during the three months preceding the event giving rise to the claim.

26. Indemnification

You agree to defend, indemnify, and hold harmless Pixel Perfects Solutions and its affiliates from claims, losses, liabilities, damages, costs, and expenses arising from:

• Your use of EstateAI
• Your User Content
• Your violation of these Terms
• Your violation of law
• Your violation of third-party rights
• Your publication or distribution of EstateAI outputs

27. Changes to These Terms

We may update these Terms to reflect changes in the service, business practices, pricing, technology, or legal requirements.

Updated Terms will be posted on this page with a revised effective date.

Continued use of EstateAI after updated Terms become effective constitutes acceptance of those Terms.

28. Governing Law

These Terms are governed by the laws applicable to Pixel Perfects Solutions, without regard to conflict-of-law principles.

Any mandatory consumer rights available under applicable law remain unaffected.
